[..] an shew that the Esquires to Knights of the Bath have immemorially
enjoyed such Exemption and shew Instances in which such Claim
was allowed I have never heard of any such and conceive that it is
no better founded than many other such Claims such as Captains of
the Guards Etc which have never been allowed

In this Year one David Jenkinson< no role > was tried at Guildhall
upon an Indictment for not taking upon him the Office of Constable
in Farringdon Ward without which he refused to do conceiving himself
exempt therefrom by reason of his being a Chelsea Pensioner but the Deft.
not being able to shew by Evidence that the Right now claimed had
ever been allowed the Recorder decided against such Claim and the Deft.
was convicted.

In many Instances Persons disabled from serving the Office
of Constable Etc. are obliged to hire others in their stead for in 1st: Sid
335. a Custom for all the Inhabitants to serve by turns according to
their Houses was held a good Custom tho' it might happen to be a
Woman and She must in that Case hire one to execute the Office
for her Vide 1 Leving 233. Sir Walter Vane< no role > 's Case.

By the toleration Act Dissenters tho' in regard to their Scruples
they are exempted from holding parochial and other Officers yet are still
eligible and are therefore enabled to hire Deputies.

Alehouse Keepers in the City of London are by reason of
their Profession deemed improper Persons to execute the Office of a
Constable and yet are elected and obliged to hire others in their stead

Upon an attentive perusal of the Charter and Acts of Parliamt:
recited in the Case the following Statements and Observations thereon
seem very material to be attended to and in my Opinion decisive of
this Question

Edward the fourth by his Charter of this Date granted to
the Master or Rules & Community of Barbers that they nor their Successors
