Deponents Tryal And saith that about seven of the clock in the afternoon of Yesterday
the said Robert Donaldson< no role > returned to this Deponent and acquainted him that he had made Street
search and enquiry for the said John Lives and could not get my information where he was or
might be met with. And this Deponent lastly saith the said John Lives lived as Clerk with
and Assistant to this Deponent and his Partner Grindall for some time before and at the time
of the negotiation of the bill of exchange in question and on which this Deponent is indicted and
is well a committed with the whole transactions respecting this Bill therefore this Deponent
saith that the said John Lives is his principal Witness and without whose testimony this
Deponent cannot without great danger to his life take his tryal on the said Indicitment
And this Deponent Roberts Donaldson for himself saith that in consequence of the other
Deponents Directions he was several home yesterday searching for and inquiring after
John Lives< no role > late Clerk to the other Deponent and William Grindall< no role > with intent to follow
him and bring him to Town to give evidence on the other Defendants tryal this day but
notewithstanding he made diligent search and inquiry for the said John Lives not only at
places which this Deponent knowns he usually frequents but at several Livery Stables
to know if he had hired any horse or Carriages to go out of Town yet this Deponent was
not able to get any information or intelligence of or respecting him. And this Deponent
further saith that Yesterday between the hours of eight and nine in the evening he
served the above named Prosecutor with a notice in writing purporting that the above
named Defendant intended to move the Court at twelve o'clock this day or so soon after
as Connect could be heard to put off his tryal till next Sessions by determining to and
leaving with the Landlady of the said Prosecutor at his Lodgings at the Castle Inn in
Wood street the notice aforesaid And that he this Deponent also between the same
hours served a like notice on Mr. Sall the Prosecutors Sollicitor.
