ThomasTayTaylor< no role > of Hamstead aforesd. Farrier maketh
Oath that on Saturday the 4th. inst. he saw the deced
and his and JohnRobt March< no role > and Walter March< no role > his
Brors. on the Heath near Mr. Heacock's House [..]
about 11 at night, that the deced was lyin [..] upon the
Ground there on wch Dept. asked if it [..] she
to wch Water Marshansweredin [..] but
Dept. cod. not hear it that when Dept. got to the [..] Walter
and Robt. as Dept. believes said that the dece [..] was drunk
and desired Dept. to assist in geting the d [..] home [..]
Dept. did & and when he was get home Dept. observed him
to be very bloody: Dept. then askedwhat had [..]

it there had been any Quarrell, to wch Walter
answered there had been a Quarrel between the deced
and Walter & that the deced had struck Walter ever the
Shoulder with a Mattock and thereby broke the Handle
from it, and the deced also with the Handle of the said
Mattock knockedthe decedWalter down by a Blow on the side
of his Head that when Walter got up, Walter struck
the deced upon the side of his Head with his Fists brot.

and so continued when Dept. left him after having been

afsd. Smith maketh Oath that on Saturday the 4th. inst. Dept. being
upon the Heath in Company with Thos. Taylor< no role > between 10th in
the Evening he saw the deced lying on the ground near Mr
Heacock's House; that Taylor asked who was there, to wch, Walter
March
< no role > or Robt. March< no role > answered some thing but Dept. can't
recollect what it was: that Dept. & Taylor then went to the deced
who was lying all man Heap upon the ground; that Walter March< no role >
said that he, meaning the deced was drunk, & desired Dept.
& Taylor to assist in geting the deced home; that the deced was
both helpless and Speechless. That he & Taylor did assist a
they with Walter March< no role > & Robt. Marsh< no role > got him home abt. 11 o'Clock
the same Evening: that he was very bloody; that Walter soon
ofter the deced was carried home told Dept. & Taylor that the deced & Rob
her Bror. had in had him sd. Walter to go abroad with them in
Order to quarrel with him, and that the deced had struck Walter
over the shoulder, pointing to his last Shoulder with the Handle of a
Pit and wch broke with the Blow and knocked him down, that when
Walter got up he struck the deced with his Fist upon one of his
Temples and knocked him down, andWalterthe deced after receiving
the sd. Blow cod. not rise did not, and there laid sulby.
