Moses Moravia< no role > and John Manoury< no role > Two of the Defendants in this Cause and David
Israel< no role > of Wool. pack Alley Hounds Ditch London Apothecary make Oath that the said
Defendants Moses Moravia< no role > and John Manowey< no role > for themselves make Oath and say
That Samuel a Newman< no role > near the Harmitage Bridge below Saint Katherine in Middle-
sex Marrinor is a Material Witness for these Deponents Concerning the Matters
Charged against them in the above mentioned Indictment and without whose Testimo-
ney these Deponents Cannot safely Proceed to Tryall on the said Indictment And these
Deponents further say that they Verily believe the said Samuel Newman< no role > is now in Parts
beyond the Seas and is not Returned and further say That they have caused Diligent Inquirey
to be made after the said Samuel Newman< no role > and are Informed and belive it to be true that the
said Samuel Newman< no role > went a Voyage to Dunkirk or near France about Three Week days
as at Pilot of a Ship and is not yet Returned as these Deponents believe but will return to
London in Three Weeks or Sooner And the said Moses Moravia< no role > for himself saith That
Wil Levi< no role > of Crutchet Fryers near Algate London Mercharnt is also a Material Witness
for this Deponent at the Tryall of the above mentioned Indictment and this Depment has
Caused Inquiry to be made at the said Joel Lewis House and is Informed and believes it to
be true that the said Joel Lewis< no role > is now in Holland beyond the Sea and that he Want to
Holland about a Month age and is not yet Returned but will return to England in a
Months Time or Sooner And this Deponent Saith that he Cannot Safely Proceed to Tryall in
the said Indictment without the Testimoney of the said Joel Lewis< no role > And this Deponent David
Israel< no role > for himself saith that he By Direction of the said Deponent Moses Moravia< no role > and
John Manouny< no role > hath Diligently Several Days Enquired after the above Named Samuel
Nowman with Intent to Subpena him to attend as a Witness for the said Deponents at
the Tryall of the said Indictment and on such Inquiry was by the said Samuel Newman< no role >
Sister who lives and keeps a Chandlers Shop at or Near the Harmitage Bridge said was
informed and believes it to be True that the said Samuel Newman< no role > about Three Weeks ago
Went to Dunkirk and is not yet Richard but that she Verily beleives he will in a Very
Short Time return to England which this Deponent believes to be True And this Deponent
also Inquired after Mr. Joel Levi< no role > with Intent to Subpona him to be a Witness at the
Tryall of the said Indictment and was Informed by the said Joel Levi's Brother at the
said House of the said Joel Levi< no role > that he did go Holland beyond Sea about a Month
ago and that he is not yet Returned but that he Expected his said Brother to Return
in a Very Short time to England And this Deponent further Saith that he Did Yesterday
Serve Mr. Charles Brown< no role > the Prosecutor Attorney in the above mentioned Indict-
ment with a Notice of Motion Importing that the said Defendants would move this
Honourable Court at this Day or as Soon after as Council Could be heard that the Tryall of
the Indictment Preferred against them may be Put off until next session by reason
of the Absence of Diverse Material Witness by leaving a Copy of such notice Signed
by the said Deponents at the House of the said Mr Brown with his Man Servant Attend
-ing at the said Mr. Browns Dwelling House in Austin Fryers London
