Charged against them in the above mentioned Indictment and without whose Testimo-

is now in Parts
beyond the Seas and is not Returned and further say That they have caused Diligent Inquirey

and are Informed and belive it to be true that the

or near France about Three Week days
as at Pilot of a Ship
and is not yet Returned as these Deponents believe but will return to

Sister who lives and keeps a Chandlers Shop at or Near the Harmitage Bridge
said was
informed and believes it to be True that the said Samuel Newman< no role >
about Three Weeks ago
Went to Dunkirk
and is not yet Richard but that she Verily beleives he will in a Very
Short Time return to England which this Deponent believes to be True And this Deponent
also Inquired after Mr. Joel Levi< no role >
with Intent to Subpona him to be a Witness at the
Tryall of the said Indictment and was Informed by the said Joel Levi's Brother at the
said House of the said Joel Levi< no role >
that he did go Holland
beyond Sea about a Month
ago and that he is not yet Returned but that he Expected his said Brother to Return
in a Very Short time to England And this Deponent further Saith that he Did Yesterday

the Prosecutor Attorney
in the above mentioned Indict-
ment with a Notice of Motion Importing that the said Defendants would move this
Honourable Court at this Day or as Soon after as Council Could be heard that the Tryall of
the Indictment Preferred against them may be Put off until next session by reason
of the Absence of Diverse Material Witness by leaving a Copy of such notice Signed
by the said Deponents at the House of the said Mr Brown with his Man Servant Attend
-ing at the said Mr. Browns Dwelling House in Austin Fryers
