William England< no role > of Alderbury in the County of Wills Yeoman
the Defendant above named maketh Oath and saith That he this
Defendant was Arrested on Saturday last the Eighteenth day of October
Instant on Suspicion of being concerned in same Act of Smuggling
whereupon this Deponent with two sufficient Securities entred into a
Recognizance before one of his Majesty's Justices of the Peace in and
for the County of Wilts for the Personal appearance of this Defendant
at the present Session of Oyer and Terminer now holding in and for
the City of London and County of Middlesex And this Deponent further
saith That on Thursday last the Twenty third day of October Insdant
he this Deponent was informed by Mr. John Turner< no role > the Clerk of the
peace for the County of Wilts that the present Session of the Peace was
begun and that therefore he this Deponent must inevitably go up to
Town and Surrender himself pursuant to his said Recognizance for
that purpose and which Information of the said John Turner< no role > as
aforesaid was the first and only Information which this Deponent
received that the present Session was now began And this Deponent
saith that upon his receiving such Information as aforesaid he
immediately set off in a Stage Coach for London in order to Surrender
himself and take his Trial upon the said Charge pursuant to his
said Recognizance and Arrived in Town for that purpose Yesterday
Morning at Eleven of the Clock And this Deponent further saith that
being wholly ignorant of the manner he this Deponent was to proceed
in order to prepare for his Defence he therefore set off from Alderbury
aforesaid to London aforesaid without bringing with him any Witness
to the present Charge and which he otherwise would have done if this
Deponent had thought it all necessary or material But this Deponent
possitively saith that he did not know ever heard or was informed
that the present Session was now holden until Thursday last
and
